Using ClyGo

Terms of Service

These terms explain the rules for requesting, completing, paying for, and tracking deliveries through ClyGo.

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and ClyGo LLC ("ClyGo," "we," "us," or "our"). They govern the ClyGo Customer app, ClyGo Driver app, recipient-tracking pages, business tools, websites, support, and related delivery services (the "Services"). By creating an account, requesting or accepting a delivery, using recipient tracking, or otherwise using the Services, you agree to these Terms and the Privacy Policy.

You must be at least 18 and legally able to enter a contract to create or operate a ClyGo account. If you use ClyGo for a company, you confirm that you have authority to bind that company. If you do not agree, do not use the Services.

2. What ClyGo provides

ClyGo provides technology and operations that help customers and businesses request local deliveries, help eligible drivers receive and complete delivery offers, and let authorized recipients receive limited status updates. Availability, timing, price, route, and driver matching depend on location, demand, package details, safety, eligibility, and other operating conditions. We do not guarantee that every request will receive a driver or arrive at an exact estimated time.

Product features may differ by device, app version, test program, market, or account type. A feature described in an app may not be available until ClyGo enables it for production use.

A prelaunch or early-access form records interest only. It does not create a ClyGo account, guarantee a launch date or service area, reserve a delivery, approve a driver, create employment, or promise offers or earnings. Driver identity, eligibility, background, vehicle, and other required reviews occur later through protected onboarding before driving access can be approved.

3. Accounts and access

  • Provide truthful, current information and keep it updated.
  • Keep credentials and one-time codes private; you are responsible for activity through your account unless you promptly report unauthorized use.
  • Use only the account role and access ClyGo approves. Do not impersonate another person, create misleading accounts, or bypass verification.
  • Do not share private recipient-tracking links outside the people who need them. Tracking access may expire or be withdrawn.
  • Contact Support promptly if an account, device, delivery, payment, or tracking link may be compromised.

4. Customer and business responsibilities

When requesting a delivery, the customer or business must:

  • Provide complete pickup, drop-off, recipient, package, access, and handoff information.
  • Have authority to send the package and provide addresses, recipient contact details, photos, instructions, and other information used for the delivery.
  • Package items safely and accurately disclose size, weight, fragility, hazards, value, and special handling needs.
  • Ensure someone is legally permitted to release and receive the package at the requested places and times.
  • Inspect quote details, fees, and instructions before confirming and pay valid charges associated with the request.
  • Not request transport of prohibited, illegal, dangerous, stolen, inadequately packaged, or falsely described items.

The customer is responsible for obtaining any recipient permission required to provide contact information or send a tracking invitation. A recipient may decline or stop tracking without cancelling the underlying delivery.

5. Driver responsibilities

Drivers must:

  • Maintain valid licenses, insurance, registrations, vehicle condition, equipment, and eligibility required for their work and location.
  • Complete verification honestly and promptly report changes that could affect eligibility.
  • Follow traffic, parking, safety, privacy, and other laws; never interact with the app in an unsafe way while driving.
  • Use reasonable care, follow lawful delivery instructions, protect packages, and complete required pickup, handoff, and proof steps.
  • Keep customer, recipient, access, package, route, and payment information confidential and use it only for the delivery.
  • Never allow another person to use the driver account or perform a delivery under the driver's identity.
  • Go offline when not available to work and keep location permissions configured as needed for offers and active deliveries.

Acceptance of an offer creates responsibility to complete it unless cancellation is permitted for safety, legality, incorrect package details, or another reason recognized by ClyGo. Drivers must use Support for material problems rather than abandoning a package or falsely completing a delivery.

6. Prices, payments, tips, and driver payouts

The app displays the available quote, price, fees, taxes, discounts, tips, or estimated driver earnings before the relevant action when reasonably possible. Amounts may change if the customer changes the request, package details are inaccurate, waiting or return service is needed, a payment fails, a refund or dispute is resolved, or applicable law requires an adjustment.

Stripe and financial institutions may process customer payments and driver payouts. Their terms may apply. By adding a payment or payout method, you authorize the required transactions and confirm that you may use that method. ClyGo may delay or withhold a payout while reviewing identity, fraud, safety, chargebacks, delivery proof, legal compliance, or an account balance. Test-mode and free test-delivery features have no cash value and are not production payment or payout promises.

Tips are voluntary unless clearly stated otherwise. Taxes, insurance, expenses, and reporting obligations associated with a driver's work are the driver's responsibility except where law requires ClyGo to collect, withhold, or report them.

7. Cancellations, refunds, and disputes

A delivery may be cancelled before completion through available app controls or Support. A cancellation fee, return-delivery charge, waiting fee, or other disclosed charge may apply depending on timing, driver progress, package possession, and costs already incurred. Refund eligibility depends on the delivery facts, payment status, proof, and applicable law; it is not guaranteed merely because a request is cancelled or delayed.

Report incorrect charges, missing or damaged packages, delivery-proof concerns, or other disputes promptly through Support. Keep relevant photos and information. ClyGo may review location, status, proof, communication, and payment records and may ask participants for additional information before deciding an adjustment.

8. Safety and emergencies

Do not use ClyGo to transport people, live animals unless expressly approved, weapons, explosives, illegal drugs, hazardous materials, cash or equivalent instruments, stolen property, or any item prohibited by law or ClyGo policy. Do not enter unsafe property, make threats, harass another participant, or continue a delivery that would be illegal or create an immediate danger. ClyGo may stop, return, hold, or refer a delivery to authorities where reasonably necessary for safety or legal compliance.

9. Photos, proof, messages, and other content

You keep ownership of content you submit. You give ClyGo a worldwide, nonexclusive, royalty-free license to host, copy, process, display, transmit, and otherwise use it as reasonably necessary to operate, secure, support, document, investigate, and improve the Services and comply with law. This license lasts for as long as the content is needed for those purposes.

Submit only content you are allowed to provide. Delivery and verification photos must be relevant, truthful, and respectful; avoid capturing unrelated people or private areas where possible. Do not upload unlawful, deceptive, abusive, infringing, or malicious content. A proof photo is evidence for review but does not guarantee that a claim or dispute will be decided in one participant's favor.

10. Acceptable use and ClyGo property

You may not:

  • Break law, violate another person's rights, or facilitate fraud, theft, harassment, discrimination, or unsafe conduct.
  • Manipulate location, identity, delivery status, proof, ratings, offers, pricing, payments, referrals, or payouts.
  • Scrape, reverse engineer, attack, overload, probe, disrupt, or bypass the Services or their access controls.
  • Use bots or automated systems without written permission, introduce malicious code, or collect information about other users outside an authorized delivery.
  • Copy or misuse ClyGo names, logos, app designs, software, documentation, or other intellectual property except as law permits.

11. Suspension, termination, and deletion

ClyGo may restrict, suspend, or terminate access; cancel or reassign deliveries; hold payments or payouts; remove content; or require additional verification when reasonably necessary to address safety, fraud, legal, eligibility, payment, policy, or service-integrity concerns. Where appropriate, we may provide notice and a way to contact Support.

You may stop using the Services and request account deletion through available in-app controls or the public deletion-request form. Closing or deleting an account does not erase payment duties or records ClyGo may lawfully retain, and provisions that logically survive—such as payment, ownership, disclaimer, liability, and dispute terms—continue to apply.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” ClyGo disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not promise uninterrupted or error-free operation, a particular driver or delivery outcome, continuous GPS or network availability, exact estimates, or that every participant will follow instructions or law. Nothing in these Terms limits a warranty or consumer right that cannot lawfully be waived.

13. Limitation of liability

To the fullest extent permitted by law, ClyGo and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or business opportunities, arising from the Services. ClyGo's total liability for a claim will not exceed the greater of the amount you paid ClyGo for the delivery giving rise to the claim or $100, except where law requires a different remedy or limit.

These limits do not apply to liability that cannot legally be excluded or limited. You are responsible for losses resulting from your unlawful conduct, material breach of these Terms, inaccurate delivery information, prohibited items, or violation of another person's rights, to the extent permitted by law.

14. Governing law and general terms

Georgia law governs these Terms without regard to conflict-of-law rules, except where another law must apply. Any court proceeding must be brought in a court with lawful jurisdiction in Georgia unless consumer or other applicable law gives you the right to proceed elsewhere. These Terms do not require arbitration.

If a provision is unenforceable, the rest remains effective. ClyGo's failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our permission; ClyGo may transfer them as part of a reorganization or business transaction. App-store, device, payment, mapping, and other third-party terms may also apply to their services. If these Terms conflict with mandatory law, the law controls.

We may update these Terms by posting a revised version and updating the date above. We will provide additional notice where required. Material changes apply prospectively unless law permits otherwise.

ClyGo LLC is located in Georgia, United States. Use the ClyGo Support form for questions, disputes, safety follow-up, or legal notices relating to the Services. Do not include passwords, full payment numbers, Social Security numbers, or driver-license numbers in the form.
